PURPOSE

Galletas Gullón S.A. a company domiciled in Aguilar de Campóo, and incorporated in Aranjuéz before the Notary Public Ángel Aguiar García, recorded in the Palencia Commercial Register in volume 18, folio 73, with tax ID (NIF) A34002501 (hereinafter Gullón) is the owner of the website located on the domain www.gullon.co.uk. Gullón, as controller of the website www.gullon.co.uk, makes this document which aims to comply with the requirements of the Law 34/2002, on E-Commerce and Information Society Services (LSSI-CE) available to users, and to inform all users of the www.gullon.co.uk website of its conditions of use. Any person accessing the www.gullon.co.uk website shall assume the role of user, undertaking to observe and strictly comply with the terms herein, and with any other legal provision that may be applicable. Gullón reserves the right to change any type of information that may appear on the web site www.gullon.co.uk, with no obligation to provide prior notice of this fact, or to inform users of said obligations, with publication on the site www.gullon.co.uk. deemed to be sufficient.

LIABILITY

Gullón shall be exempt from any liability deriving from the information published in www.gullon.co.uk, when this information has been manipulated or entered by an unrelated third party. It is possible that users may be redirected from www.gullon.co.uk to the content of third party websites. Given that Gullón is not always able to control the content that third parties place on their websites, the company shall not assume any liability in respect of said content. In any case, Gullón states that they shall proceed to the immediate withdrawal of any content that could contravene national or international law, morals, or public order, and shall immediately proceed to withdraw redirection to the website in question, while informing the competent authorities of the content in question. Gullón shall not be held liable for any content and information stored, including but not limited to, forums, chats, blogs, comments, social networks, or any other medium that permits third parties to publish content in an independent manner on the www.gullon.co.uk website. Notwithstanding this fact, and in fulfilment of the terms of art. 11 and 16 of the LSSI-CE, Gullón shall make available to all users, authorities and security forces, and shall collaborate actively in the withdrawal or if appropriate, blocking thereof, any content that could affect or contravene national or international law, third party rights or morals and public order. In the event that a user considers that the www.gullon.uk website contains content that could be classified as described above, they are requested to immediately notify the web administrator atinfo@gullon.es. www.gullon.co.uk has been checked and tested to ensure that it functions correctly. In principle, correct operation can be guaranteed 365 days per year for 24 hours a day. Nevertheless, Gullón shall not rule out the possibility that there could be programming errors, or that events of force majeure, natural catastrophes or strikes may occur, or any similar circumstances that may render it impossible to access the website.

PORTAL USERS’ CONDITIONS OF USE

Access to www.gullon.co.uk is free, except for the cost of connection through the telecommunications network provided by the access service provider contracted by users. Use of the website www.gullon.co.uk is expressly prohibited for any purposes that are detrimental to the assets or interests of Gullón or third parties, or which in any other way overload, damage, or incorrectly use the networks, servers and Gullón’s other computer equipment or products and applications, or those of third parties. Users shall assume liability for their use of www.gullon.co.uk and they undertake to make adequate use of the content and services that Gullón offers through its portal and not to use them for the following, without limitation:

• To carry out any illicit or illegal activities or those contrary to good faith and/or public order.
• Disseminate content or propaganda of a racist, xenophobic, or illegal pornographic nature, or which apologises for terrorism or any content that contravenes or violates human rights.
• Cause damage to Gullón’s physical and logical systems, their suppliers or third persons, introducing or circulating computer viruses on the network or any other physical or logical systems that could cause the aforementioned damage.

Gullón shall pursue any failure to comply with these conditions, as well as any misuse of www.gullon.co.uk, and shall take all the civil and criminal actions that may be appropriate under law in this regard.

PRIVACY POLICY

Users may obtain information on the personal data processing that Gullón carries out in www.gullon.co.uk through the link to the Privacy Policy.

INTELLECTUAL PROPERTY

The www.gullon.co.uk, website as well as, without limitation, its programming, publication, compilation and other elements required for its operation, such as the designs, logos, text and or graphics are all the property of the service provider, or as appropriate, are under licence or have their authors’ express authorisation for use. All the content of the website is duly protected by intellectual property law and recorded in the appropriate public registers. Irrespective of the purpose for which they were intended, any total or partial reproduction, use, exploitation, distribution and marketing requires in all cases the service provider’s prior written authorisation. Any use that has not been previously authorised by the service provider shall be deemed to be serious non-compliance with the author’s intellectual or industrial property rights. The designs, logos, text and /or graphics which are not the service provider’s property but which may feature on the website, belong to their respective proprietors and they shall be liable for any possible dispute arising in this regard. In any case, the service provider shall have the prior express authorisation of said owner in this regard. . Gullón recognises the titleholders’ intellectual property rights in respect of any mention or appearance on the website which shall not imply any right or liability on the part of the service provider regarding these, nor shall this be deemed to be support, sponsorship or recommendation by the service provider. AMENDMENT OF THESE CONDITIONS AND DURATION

Gullón may modify these conditions as determined, duly published, and appearing herein at any time. The validity and duration of these conditions shall be based on their publication herein and they shall remain valid until they are amended by any other terms that may be published in due course.

JURISDICTION

In the event of any dispute that may arise regarding the interpretation of these conditions of use, or their access and use of the same, both Users and Gullón expressly submit to Spanish law and the courts and tribunals that may be applicable in this case, as appropriate. Furthermore, in the event of conflict relating to consumer regulations and those concerning users, said users are advised that they may access the European Commission’s platform for online dispute regulation.
